Huurovereenkomst
Contract.
When contracting us to rent Casa da Confraria, no contract will exist between us until we have received the required deposit and we have issued the official confirmation invoice.
Web site Information.
Great care has been taken to ensure the accuracy of the information contained in our brochure and web site relating to any service advertised. However, all statements as to the condition of the property or other services included in the web site must not be treated as statements of fact but statements of opinion.
Payment.
If the booking is made more than 56 days prior to departure, deposits are payable as follows: 30% of the Villa rental cost. The balance of the cost will be shown on the confirmation invoice and must be paid 56 days prior to departure. If payment is not made by the due date we reserve the right to cancel the holiday lets and to apply cancellation charges.
Late bookings.
Bookings within 56 days of departure are deemed late bookings. Full payment is required immediately and once received by us, all booking conditions apply.
The Cost.
The price payable is the price relating to the holiday lets of Casa da Confraria as published from time to time and detailed in the information sent to you by us (price list and general information). Where the cost of the holiday lets falls under two seasonal prices, the rate applicable shall be charged. The total cost of the holiday lets will only be subject to surcharges in the event of any Government action. Should any increases imposed exceed 10% of the holiday cost, you may cancel and receive a full refund provided the cancellation is made within 14 days of being notified of any such increase.
Cancellation by you.
Cancellation by you needs to be in writing. We will refund you on the following basis, more than 56 days 70%, 56-29 days 50%, 28-15 days 20% and 0-14 days 0%.
Cancellation by us.
We may occasionally have to cancel your holiday lets as a result of force majeure, that is any occurrence outside our control and which could not have been avoided with all due care.
Modification by you.
If you wish to modify your booking once it has been confirmed, we may accept the alterations. Changes to your holiday dates for the villa rentals will be treated as cancellation and re-booking and the applicable cancellation charges as set out above will apply.
Modification by us.
If a significant change (see 18) occurs to any part of your rental period we will advise you as soon as possible providing we know of any change prior to your departure. You will be given the choice of accepting revised arrangements or cancelling and accepting a full refund of all monies paid to us.
Our Liability to you.
We have taken all due care in making the arrangements applicable to your holiday but we cannot accept liability in respect of any injury, loss or damage however caused to you unless by our direct negligence.
Transferability.
If you or a member of your group is unable to travel you may transfer that place to another person provided we have 14 days notice and that the substitute member satisfies these booking conditions. All costs incurred in making the changes must be paid when the transfer is made.
Security deposit.
A security deposit of $1000 is payable by you on arrival. This may be paid in cash. The amount of this deposit will be shown on the information sent to you by us.
Care of Property.
You are responsible for ensuring that the house provided are left upon departure in the same condition of cleanliness and repair as upon arrival. Any loss or damage caused by your failure to respect the property fixtures or fittings will be deductible by the breakages deposit.
Party Size.
Property Owner reserve the right to refuse admittance if the number of persons arriving exceeds the the maximum sleeping places. We can accomodate six people in the Large House and five people in the Small House.
Animals.
We regret that our guest cannot bring animals to Casa da Confraria.
Smocking.
No smocking is allowed on the premises of Casa da Confraria including the Patio and the Garden.
Complaints.
We hope that you are not dissatisfied with any aspect of your holiday lets. In the event that you are dissatisfied you must report the cause to the Property Manager, to allow us the opportunity to rectify the problem. In the unlikely event that you are still not satisfied upon your return from holiday lets, you must write to us giving full details within 14 days. If you fail to notify us of any dissatisfaction during your holiday we cannot accept liability for that complaint in retrospect.
Law and Jurisdiction.
Your contract with us is governed by Portuguese Law and to the exclusive jurisdiction of the Portuguese Court.
Force Majeure and Significant Change.
These include events which are caused as a result of acts of God, Governments, hostilities of war, political unrest, riot, civil strife, industrial dispute, natural or nuclear disaster, fire, theft, epidemics quarantine, medical or customs regulations, technical or administrative problems with transport, closure of airports, breakdowns with machinery and equipment, adverse weather conditions, water shortages or any other occurrences outside our direct control and could not have been avoided even with all due care.
Insurance Cover.
It is a stipulation of the booking that you must arrange a suitable insurance cover. This should be to cover you against loss of irrevocable deposit and charges following necessary cancellation of your holiday rental from death, injury or illness occurring after your booking or been made redundant all occurring before arrival at Casa da Confrasria.
